Terms of Service.

Welcome to @diet. These Terms of Service ("Terms") govern your access to and use of the @diet website, brand, services, and any associated channels (the "Service"), operated from New York, NY, United States (collectively, "@diet", "we", "us", or "our"). By using the Service, submitting a video, inquiring about a paid feature, or subscribing to our newsletter, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service and at least 18 years old (or the age of majority in your jurisdiction) to enter into any paid agreement, including restaurant feature packages or trophy evaluations. By using the Service you represent that you meet these requirements and that any information you submit is accurate and your own.

2. What @diet Is

@diet is an editorial brand and food-discovery platform focused on New York City restaurants and food creators. The Service includes (but is not limited to) curated video features, written guides, the "Cheat Meal Trophy" editorial recognition program, paid restaurant feature packages, a creator-submission pipeline, and a weekly newsletter. The Service is provided on an "as is" and "as available" basis and may change at any time.

3. Creator Submissions

When you submit a video, link, image, caption, or any other content (collectively, "Submission"), you:

Warrant ownership. You created the Submission, or have all necessary rights, licenses, and permissions from any people, brands, restaurants, or rightsholders shown or referenced.
Grant us a license. You grant @diet a worldwide, non-exclusive, royalty-free, sublicensable license to host, repost, reformat, adapt, and feature the Submission on our website, social channels (including Instagram), newsletter, and partner channels, with credit to your handle whenever practical.
Accept editorial discretion. We may decline, edit, caption, crop, re-encode, or remove Submissions at any time for any reason, including editorial fit, quality, legal risk, or community standards.
Indemnify us. You agree to defend and indemnify @diet against any claim arising from your Submission, including claims of copyright infringement, defamation, right-of-publicity violations, or unauthorized use of trademarks.

We do not pay creators for organic Submissions unless explicitly agreed in writing. Submissions are not returned. For paid creator engagements (e.g. via the restaurant creator-pipeline), separate written terms apply.

4. Restaurant Feature Packages

Restaurants may purchase paid feature packages (currently "Single Feature", "Trophy Evaluation", and "Annual Pipeline"). Pricing on the Service is illustrative; the actual scope, deliverables, timeline, and pricing of any engagement will be confirmed in writing (email is sufficient) before payment. By paying for a package, you agree:

Trophy is editorial. Paying for a Trophy Evaluation purchases a good-faith evaluation, not a guaranteed Cheat Meal Trophy. Trophies are awarded at our sole editorial discretion based on merit.
Refunds. Single Feature and Trophy Evaluation fees are non-refundable once we have commenced work (creator dispatch, in-person evaluation, or editorial scheduling). Annual Pipeline subscriptions may be cancelled with 30 days' notice; unused months are refundable on a pro-rata basis.
Disclosure. Paid placements may be marked as "sponsored", "partner", or similar where required by FTC guidelines or platform rules. Trophy awards are editorial and not paid for.
No price-lock. Package pricing may change. The price you saw on the Service does not guarantee a future engagement at that price; quoted prices in our written confirmations do.
Comp obligations. Where a package involves a creator visit, the restaurant agrees to comp the meal in good faith. The creator is independently engaged; @diet is not the creator's employer.

By subscribing to the @diet newsletter you consent to receive editorial emails on a roughly weekly cadence. We may include sponsored sections clearly marked as such. Every email contains a one-click unsubscribe link; we will honor unsubscribes promptly. By inquiring as a restaurant or submitting as a creator you also consent to transactional replies (responses to your inquiry, follow-ups, contracts) regardless of newsletter status.

6. Intellectual Property

The @diet name, the "@diet" wordmark (italic), the "Cheat Meal Trophy" name and tier designations ("worth a try", "worth a detour", "worth a flight"), the "On The Diet" tagline, our trophy iconography, and the look and feel of the Service are owned by @diet. You may not copy, reproduce, or use them other than to credit or link to us, except with prior written permission. Restaurants awarded a Cheat Meal Trophy receive a limited license to display the trophy sticker, plaque, and tier mark at their physical location and on their owned digital channels for so long as the trophy remains in good standing.

7. DMCA / Takedown

We respect intellectual property rights. If you believe content on the Service infringes your copyright, send a written notice to areibifamily@gmail.com with: (a) your contact info; (b) a description of the work; (c) the URL or location of the allegedly infringing material; (d) a statement of good-faith belief; (e) a statement under penalty of perjury that you are authorized to act for the rightsholder; and (f) your physical or electronic signature. We will respond promptly and may remove or restrict the material.

8. Prohibited Conduct

You agree not to:

Submit content you do not have the right to submit, or that is defamatory, harassing, hateful, or unlawful.
Attempt to gain unauthorized access to the Service, bypass any security or rate limit, or scrape at scale.
Misrepresent yourself, a restaurant, or a creator (including impersonation or fake reviews).
Pay, threaten, or coerce a Cheat Meal Trophy in a manner inconsistent with our editorial process.
Use the Service to send spam, malware, or unsolicited commercial messages.

9. Third-Party Services and Links

The Service relies on third-party tools (including form processors, hosting, analytics, fonts, image CDNs, and Instagram). The Service may also link to external sites we don't control. We are not responsible for the content, terms, or privacy practices of those third parties. Your interactions with them are governed by their own terms.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. RESTAURANT REVIEWS, TROPHY DESIGNATIONS, AND EDITORIAL OPINIONS ARE OPINIONS, NOT STATEMENTS OF FACT, AND ARE PROVIDED FOR ENTERTAINMENT AND DISCOVERY PURPOSES.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, @DIET, ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF REVENUE, PROFITS, GOODWILL, OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID @DIET IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN DAMAGES, SO THESE LIMITS MAY NOT APPLY TO YOU.

12. Indemnification

You agree to defend, indemnify, and hold harmless @diet from any claim, damage, liability, cost, or expense (including reasonable attorneys' fees) arising from (a) your use of the Service, (b) your Submissions or content, (c) your breach of these Terms, or (d) your violation of any law or third-party right.

13. Termination

We may suspend, restrict, or terminate your access to the Service at any time, with or without notice, for any reason, including suspected breach of these Terms. Sections that by their nature should survive termination (including IP, indemnification, disclaimers, limitation of liability, and governing law) will survive.

14. Governing Law and Venue

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute arising out of or related to these Terms or the Service will be brought exclusively in the state or federal courts located in New York County, New York, and you consent to personal jurisdiction in those courts.

15. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page indicates when the most recent change was made. If we make material changes, we will provide reasonable notice (e.g. via the website or email). Your continued use of the Service after changes take effect constitutes acceptance.
